Order Terms
These terms apply to bottles ordered through the Cask Trade Christmas Bottling Campaign (CTCBC).
1. Your (“Customer”) order
1.1. Your order is not confirmed until Cask Trade (“Supplier”) has:
1.1.1. Received a completed and signed CTCBC form from you
1.1.2. confirmed availability and pricing in writing;
1.1.3. received all required personalisation or artwork information; and
1.1.4. received payment, unless credit terms have been agreed separately.
1.2. All orders are subject to availability. If we cannot accept an order, we will notify you and refund any payment already received
2. The product
2.1. The product is a 70cl bottle of Speyside Single Malt Scotch Whisky, distilled in 2015 and bottled at 46% ABV
2.2. Each bottle will carry the standard Cask Trade strip and back labels (see Appendix 1 for illustration). The top label can either:
2.2.1. use the Cask Trade Christmas design with an approved personalised message; or
2.2.2. use artwork supplied by the customer
2.3. Minor variations in label colour, positioning and finish may occur during printing and hand application.
3. Personalisation and artwork
3.1. Cask Trade will supply the artwork to the customer based upon the customers instruction
3.2. Customers are responsible for checking and confirming to Cask Trade that all names, messages, logos and other information supplied are complete and correct.
3.3. Customer-supplied artwork must meet the specifications provided by Cask Trade. We may make minor technical adjustments where required for printing, but we will not make material changes without approval. Please note the label must comply with Scotch Whisky regulations 2009. Cask Trade will ensure this is the case
3.4. A final artwork proof will be provided for approval. Production will not begin until written approval has been received in writing. Once approved, the customer accepts responsibility for the content, spelling, layout and other details shown on the proof
3.5. The customer confirms that they own, or have permission to use, any names, logos, images or other material supplied to us. We may reject artwork that is unlawful, offensive, misleading, technically unsuitable or likely to cause a compliance issue
3.6. Delays in supplying or approving artwork may affect the estimated delivery date.
3.7. Only 2 changes will be required to the artwork after which the customer will incur additional costs.
4. Prices and payment
4.1. Prices will be confirmed when the order is accepted and will state whether Duty, VAT and delivery are included.
4.2. Payment is required in full before production begins unless alternative terms have been agreed in writing.
4.3. Any additional work requested after artwork approval may be charged separately. We will confirm any additional charge before carrying out the work.
4.4. The bottles remain the property of Cask Trade until payment has been received in full.
4.5. Bottles will only be shipped once full payment has been received.
5. Changes and cancellations
5.1. You are required to inform us in writing within 14 days of the date of the signed CTCBC form if you need to change or cancel an order.
5.2. As the bottles and labels are produced or personalised specifically for each customer, an order cannot normally be changed or cancelled once artwork has been approved or production has begun. No refund will be issued.
5.3. Where we agree to a cancellation, we may deduct costs already incurred, including design, printing, production and administration costs.
5.4. This does not affect any legal rights you may have where a product is faulty, damaged, incorrectly supplied or not as described.
6. Delivery
6.1. Delivery dates are estimates unless we have expressly confirmed a guaranteed date in writing.
6.2. Cask Trade is not responsible for delays caused by incorrect or incomplete delivery information, delayed artwork approval, the customer’s nominated carrier or any other events outside our control.
6.3. Additional charges may apply for:
6.3.1. deliveries to multiple addresses;
6.3.2. timed or specialist deliveries;
6.3.3. redelivery following an unsuccessful delivery;
6.3.4. delivery outside mainland Great Britain; or
6.3.5. export documentation and international shipping.
6.4. The customer is responsible for checking that all recipient and delivery information is accurate. Risk in the bottles passes to the customer when they are delivered or collected by the customer or their nominated carrier
7. Damage, shortages and errors
7.1. Orders should be checked as soon as reasonably possible after delivery.
7.2. Please notify Cask Trade promptly of any damage, shortage or incorrect personalisation and provide photographs where possible. If the bottles are faulty, damaged or do not match the approved order, we will offer an appropriate replacement, correction or refund.
7.3. Nothing in these terms limits the customer’s statutory rights.
8. Insurance
8.1. The customer will insure the bottles until delivery to a designated address of the purchaser
8.2. The Purchaser agrees that no insurance advice has or will be given by Cask Trade
9. Alcohol and age restrictions
9.1. Alcohol may only be purchased by someone aged 18 or over.
9.2. Orders must only be delivered to, or accepted by, a person aged 18 or over. Proof of age may be requested on delivery, and delivery may be refused where satisfactory identification cannot be provided
10. Recipient information
10.1. Where a customer provides recipient names, addresses or other personal information, the customer confirms that they are entitled to provide that information to Cask Trade for the purpose of fulfilling the order.
10.2. Cask Trade will use this information only to process and deliver the order and in accordance with its privacy policy.
11. Liability
11.1. Cask Trade will not be responsible for losses caused by inaccurate information, artwork or delivery details supplied by the customer
11.2. Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, personal injury caused by negligence, or the customer’s statutory rights.
12. Force Majeure
12.1. Neither of us shall be in breach of the contract nor liable for delay in performing, or failure to perform, any of our obligations under the contract if such delay or failure results from a Force Majeure Event. In such circumstances the affected party shall be entitled to a reasonable extension of the time for performing such obligations. If the period of delay or non-performance continues for four weeks, the party not affected may terminate the contract by giving 7 days' written notice to the affected party. “Force Majeure Event” means an event or sequence of events beyond a party's reasonable control preventing or delaying it from performing its obligations under the contract including an act of God, fire, flood, lightning, earthquake or other natural disaster, interruption or failure of supplies of power, fuel, water, transport, equipment or telecommunications service, epidemic, pandemic or industrial action, but excluding your inability to pay or circumstances resulting in your inability to pay.
13. Disputes
13.1. We will try to resolve any disputes with you quickly and efficiently. If you are unhappy with the goods, our service to you or any other matter, please contact us as soon as possible.
13.2. If you and we cannot resolve a dispute using our internal complaint handling procedure, we will let you know that we cannot settle the dispute with you, and give you certain information required by law about our alternative dispute resolution provider.
13.3. Alternative dispute resolution. Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If we cannot resolve a dispute or if you are not happy with how we have handled any complaint, you can submit a complaint to the London Arbitration Centre – www.londonarbitrationcentre.com. The London Arbitration Centre will not charge you for making a complaint and if you are not satisfied with the outcome you can still bring legal proceedings.
14. Governing law
14.1. These terms are governed by the laws of England and Wales. Nothing in this section affects any mandatory rights a consumer may have in the part of the United Kingdom where they live.
